FYI, I've tried this on the current head (af1e2b0) and it appears to function. Have you tried testing with a build from the master branch?
Additional details about what permission error you're receiving would be helpful to determine if it's an issue with the Gaming Mode function or something else.

As a note - I have been able to improve the performance of the volume wheel by using contact cleaner. After cleaning, mute & volume control were 100% accurate.
