upload overwrite prevent not working?

Hi there I have the setting to prevent overwrite of newer files set to true, however it doesn't prevent such upload...is there a specific warning I should get ?

First of all, excellent extension! After opening with ctr shift L, is there a way to close the popup with a shortcut or escape ? thanks
