Safe Mode & Clone Resolution: WP_SITEURL vs. WP_HOME

Behavior: In a WordPress Multisite instance with WordPress in a subfolder /cms the "Safe Mode & Clone Resolution" features is failing permamentely.

In the Network Dashboard I get the notice, that subdomain.example.com is a dupicate of subdomain.example.com/wp. These are the exact same pages, the only difference is that first is what WP_HOME would output and latter what WP_SITEURL would output. Solving this by choosing the option that subdomain.example.com is the new home of subdomain.example.com/wp solves that until the dashboard of the subsite is accessed. Here Freemius registers again with subdomain.example.com/wp and the Network Dashboard again wants tol solve that.
